On January 28, 2016, during the trial of Chris Brandt Jr, the Judge Me Jean Wilner Morin, after the identification process of the accused and his five other accomplices in the court room [Sawadienne Jean (30), Carlo St-Fort (30), Carline Richemard (30), Pierreval Ricot (39), Saint-Fort Carlo Bendel and Evens Larieux (45)], ordered the suspension of the hearing and announced the resumption of the trial on 15 February, 2016. A dozen of lawyers were present in the courtroom to defend Clifford Brandt, who has been arrested on charges of Kidnapping, illegal restraint against ransom, conspiracy, usurpation of title, death threats, forgery and use of forgeries, illegal possession of firearms and money laundering. The trial was again postponed on February 15, because the accused Chris Brandt was absent in the courtroom.

Jocelerme Privert, the former President of the Haitian Senate (14 January 2016 - 14 February 2016) and Senator for Nippes Department (26 April 2011 - 14 February 2016) was elected as the interim president of Haiti. He will lead a caretaker government that will fill the void left by President Michel Martelly after the end of his term. His priority would be to ease the tensions of suspended election and to hold the overdue presidential election on April 24, 2016 and install a new President on May 14, 2016, all within his 120-day term. Jocelerme Privert is an experienced politician and administrator with 35 years of experience in public service.

As per the Institute for Criminal Policy Research and MINUSTAH December 2015 statistics, considering an estimated national population of 10.78 million at the end of 2015, Haiti's prison population rate per 100,000 of the national population is 102. Haiti has an official capacity of 2,431 inmates in its prison system of 17 prisons with an occupancy level of 454.4%. The prison population for the December 2015 shows a number of 11,046 detainees and of that percentage, the share of pre-trial detainees and female prisoners are 70.9% and 4.1% respectively. The new prison will replace an outdated Pétion-ville prison with 50 inmate capacity which currently houses 305 prisoners. Moreover, the new prison will protect the privacy of the women prisoners, which is a definite matter of concern. Over 25% of women are being held without legal cause, and many of them wait anywhere from three to seven years before even going to trial.

Crime, human rights abuses, inside Haiti's prisons

Nearly 5000 Haitian criminals are being held in a building originally built in the 1930's and meant for only 1,500 inmates. The situation at Haiti's National Penitentiary is much the same in the country's other prisons. The overcrowding makes preserving order an uphill battle. A system of rotation allows officials to stop gangs from reforming within the walls, but the problem is exacerbated by delays in the judicial system. Many of the inmates are being held pending trials that may take many months to come.

On December 17, 2015, Dieudonne Pierre Bélizaire, better known as Sister Dona, founder of the orphanage of 'Sisters Redemptive of Nazareth", has been cleared of kidnapping charges in a criminal court in Port-au-Prince, and was released immediately. Sister Dona was in the Civil Prison of Petion-ville since 21 June 2012 in connection with the kidnapping of a child named 'Raphaël Chenet' from her orphanage, a crime which she vehemently denied from the beginning. During the crime, as per report, she was not even in Haiti. As per Kenscoff Peace Court records, Djimmy Mémé, one employee of the orphanage, had confessed the crime on July 18, 2011; he took $2,000 from a couple (Péguy Blanc and Christine) who wanted to adopt Raphaël Chenet. Djimmy picked up the child from the orphanage and handed the child to Péguy Blanc. Most of these facts were confirmed by Djimmy's cell phone records and were noted in the Registry records of the Kenscoff Peace Court. However, Djimmy Mémé, the main criminal of the crime despite his confessions and facts, was released by the Substitute Commissioner of the Government, Rodriguez for unknown reasons.

Draft revision of the Haitian Penal Code

Here is a pictured of the Draft revision of the Haitian Penal Code as President Michel Martelly is holding it.

The National Palace was the scene of the presentation of a new draft of the penal code that has not undergone significant changes in 180 years. President Me Exume of the Presidential Commission for the Reform of Justice did the major work on it.

President Martelly received the draft in the presence of Prime Minister Paul as well as other government officials. Martelly emphasized the historic, sociological, and political significance of the modernized penal code. The new Parliament in 2016 will officially adopt it.

Enold Florestal and his brother Josue, who were arrested and imprisoned 17 months ago on the charge of murdering a student named Frantzy Duverseau at his Port-au-Prince home on October 18, 2010, have been released from prison on December 19, 2014, three days after an Appellate Court ruled. On August 27, 2013, Haitian investigative judge Lamarre Bélizaire (he is said to be close to Martelly's government) ordered the arrests of four people--two brothers, Enold and Josué Florestal, their attorney André Michel and a police agent named Jeanco Honorat. The two brothers were plaintiffs in a suit accusing First Lady Sophia Martelly, and his son, Olivier Martelly, of corruption. On October 18, 2010, following an altercation between Mr. Enold and his in-laws, Enold reportedly assaulted his wife Fabienne Duverseau. When her brother Frantzy intervened, Enold was injured. He went to call the police and came back to the spot with his brother Josué, their attorney, André Michel and a police agent named Honorat. When Frantzy resisted arrest, Honorat shot him dead. In a September 2 report, Haitian independent National Human Rights Defense Network concluded the failure to identify which of the accused was a material author and which one acted as accomplice and issuing arrest warrant in such a state "constitutes a vast joke."

Jean Bertrand Aristide is under House Arrest, according to HCNN

Haitian Caribbean News Network, a pro Government news site has reported that Former President Jean-Bertrand Aristide has been placed under house arrest. Also from the same source, the residence of former Haitian leader located in Tabarre will now be guarded by agents of the prison administration (APENA). Also, based on the last order issued by Judge Lamarre Belizaire, the perimeter of the residence will be under the control of the Central Directorate of the Judicial Police (DCPJ ).

Haitian Caribbean News Network also reported that from now on, only Judge Lamarre Belizaire could authorize anyone to visit Jean-Bertrand Aristide, in his residence in Tabarre.
